Fair Use Policy for Unlimited Business Telephony Services

To guarantee the quality of services to all our clients, NGX has adopted this fair use policy for unlimited business telephony services.

This Policy establishes the terms and conditions in which our clients must use the Service in accordance with the provisions of the Telecommunications Service Provision Contract and is designed to prevent fraud and abuse of our Service.

NGX business telephony service is a voice service designed to process and deliver business calls to our clients in which Unlimited calls to national landlines and mobiles are allowed. In accordance with our Service Provision Agreement, this Fair Use Policy serves to prevent the use of the telephone service from conforming to the consumption of a company according to its needs and does not imply different use so as not to violate what is agreed in contract. We reserve the right to terminate the relationship with the client or, where appropriate, suspend the contracted plan immediately if it identifies that the use of Unlimited Telephony goes against this Fair Use Policy or against the terms and conditions established in our Contract. NGX will notify the customer via a usage notice just prior to suspension or termination of their contracted plan and may possibly offer an alternative plan.

The following activities are prohibited:

Use of automatic dialers, Telemarketing or Call Centers. Shared use of the Service between users of different companies through a PBX system (telephone switch), call center, computer equipment or any other means. Use of fax machines for bulk or unsolicited transmissions. Extensive call forwarding or use of conference or call forwarding features to act as a bridge to other phone lines or other conference facilities. Transmission or reception of programs through teleconference means, among others. Transmission or reception of recorded material and communications other than business calls between natural persons. Marketing, sale, or resale of telephone services to third parties or any similar activity on the service. Calls to numbers that generate income for the client or third parties, as well as participation in activities that may generate payments to a client as a result of the use of the Service. Unusual calling patterns that are not consistent with Business Use of the Service such as frequent calls of short duration or calls to several numbers in a short period of time. Use of the Service or equipment in an illegal way and / or that violates the Service Provision Agreement. Use any automatic means to manipulate the Service.

We reserve the right to review your account and take additional action, including, but not limited to, immediate suspension of your service if account usage exceeds normal standards for typical customers of the same calling plan, unacceptable or disruptive. for our operations or for the ability of other customers to use the service. We may charge for abnormal usage based on comparisons with the usage patterns and levels of other customers with the same plan (s). If we determine that you are making abnormal or unauthorized use, we will make a commercially reasonable effort to inform you and provide you with an opportunity to correct such inappropriate use. If we give you the opportunity to correct your abnormal usage patterns and you do not immediately adjust to normal use, we may exercise our right to transfer your service to a more appropriate plan, apply the applicable rates for that plan, implement other limitations, or suspend or cancel. your service, with or without notice. If we believe that our service has been used for an illegal purpose, we may terminate the service immediately with or without prior notice and / or forward the communication and other relevant information to the appropriate authorities for investigation and prosecution. We reserve all legal rights.
